Processing of your personal data
§ 3 Data collection and processing once you enter the website Generally speaking, you are free to use our website without any need to state any of your personal data. However, every time you access our website, the following data (access data) will be anonymously and temporarily recorded by us and saved as a logfile on the server of our provider:

 

IP-Address of your device,

Date and time of the access,

Name and URL of the data that was requested,

Website from which the access to our website happened,

Name of the internet service provider,

Amount of data transferred,

A status, whether or not the access was successful,

Data for the recognition of your browser and your operating system.

 

This data is collected for technical reasons and only used for statistical

purposes and to improve our offer. This data is saved in a way that does

not allow to draw any conclusions about your identity so that your personal identity cannot be determined by this data. This data will be either deleted at the end of the connection or anonymized. Legal basis for the temporary storing of this data is according to Art. 6 Para. 1 letter f General Data Protection Regulation (GDPR) our legitimate interest to technically provide our website.

§ 4 Obligation to provide the data Generally speaking, you are free to state or disclose any personal data on this website and you are in principle neither legally nor contractually obliged to do so. If, under special circumstances, there should be an obligation to do so, we will inform you about this regarding the respectice data process separately.

In principle, there are not any disadvantages for you, if you wish to not disclose any personal data. This applies to a refusal to set cookies, as well. However, it is possible that in this case not all the functions on our website can function correctly.

§ 5 Contact If you have any questions, suggestions or requests you can contact us via e-mail under mail@nachtwey-ip.de. In this case, we will process your e-mail-address, your message and the data that you have stated in your message.

However, your e-mail-address is only used for the communication between you and us. It is not used for any other purposes.

Lastly, we also store date and time of your contact request.

PURPOSE OF THE PROCESSING:

The data you provide will be used to process your request and in the event of follow-up questions.

LEGAL BASIS:

Legal basis for the processing of your personal data, which you have submitted via e-mail, is Art. 6 Para. 1 letter f GDPR, namely our legitimate interest to be able to reply to the e-mail and to answer your inquiry.

If your request is aimed at concluding a contract, Art. 6 Para. 1 letter b GDPR applies as a further legal basis.

STORAGE TIME:

The data transferred to us will be stored by us for the duration of the communication with you. After the final completion of the communication, the data will be deleted, unless there are legal retention periods.

RECIPIENTS OR CATEGORIES OF RECIPIENTS:

Your message will be transferred via the e-mail provider we use and will be stored there, as well. In order to secure your rights, we have concluded an order processing agreement with the recipient.

TRANSFER TO A THIRD COUNTRY OR INTERNATIONAL ORGANISATION:

The personal data you provide when contacting us will not be transferred by us to a third country or an international organisation.

For instance, this is the case with links that refer to our cooperation partners, the link that refers to the website of our website-software “Wordpress”, as well as the link to our presence on Google+. § 7 Your rights as data subject You can exercise the following rights against us with regard to your personal data:

· the right to information pursuant to Art. 15 GDPR

· the right to correct and/or complete the data in accordance with Article 16 GDPR

· the right to the deletion of personal data in accordance with Art. 17 GDPR

· the right to limitation of processing in accordance with Article 18 GDPR

· the right to data transferability in accordance with Art. 20 GDPR

Furthermore, you have a right of appeal against a data protection supervisory authority with regard to the processing of your personal data with and by us.

§ 8 Right to revoke a previously issued declaration of consent In case you issued a declaration of consent with regard to the processing of your personal data by us, you are free to revoke your consent at any time and with effect for the future. Any processing of your data prior to the revocation will not be affected in its legitimacy.
§ 9 Right of objection in case of processing based on our legitimate interest
  • Moreover, you also have the right to object at any time to the processing of your personal data under art. 6 par. 1 letter e) respectively f) GDPR, including profiling based on these provisions. You may object to the processing based on grounds arising from your particular situation. In this case, we will no longer process the personal data unless we can prove compelling reasons worthy of protection for the processing, which outweigh your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.

 

  • Additionally, if we process personal data for direct marketing purposes, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling, insofar as it is associated with such a direct marketing.
§ 10 Right to lodge a complaint If you consider that we infringe the GDPR, you have, according to art. 77 GDPR and in addition to your rights mentioned above, the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work or the place of the alleged infringement.
§ 11 Data safety We took the necessary technical and organizational measures in order to secure that your personal data is protected against any unauthorized access, destruction, loss or modification by third parties.
§ 12 Our right of modification We reserve the right to alter this privacy policy at any time with effect for the future. This might be necessary, because of the steady further development of our website or in order to comply with the legal provisions.
